I. Terms and conditions for the purchase and donation of trees
Through the current purchase and donation, you’re taking part in the program to reduce the carbon footprint. The aforementioned program seeks to raise awareness among passengers of the international airport Arturo Merino Benítez (the “Airport”) of the carbon emissions from commercial aviation, and to reduce the carbon footprint generated by commercial transit through the Airport. So as to reach said objectives, the program consists in the delivery of information to the passengers of the Airport in this respect, and the promotion of the purchase and donation of trees to the Illustrious Municipality of Pudahuel (the “Municipality”), contributing to the mitigation of emissions generated by aviation commercial in the commune of Pudahuel.
This system will exclusively be used for the purchase and donation of trees to the Municipality.
You hereby declare to be of legal age of consent in accordance with Chilean legislation, and have the legal capacity to enter into this sales contract with Williamson y Vidal Ltda., R.U.T. No. (tax number) 77.542.570-9 (the “Supplier”).
This system will exclusively be used for the purchase and donation of trees to the Municipality.
In consideration of the above, it is expressly stated that Sociedad Concesionaria Nuevo Pudahuel S.A. (“SCNP”) will not be responsible or intervene in any conflict related to said sales contract, since SCNP does not have nor will have any contractual relationship with you.
You declare to be able to donate and transfer freely and irrevocably the tree to the Municipality. In order to process the donation, you entrust the Supplier to deliver the tree directly to the Municipality, without making an intermediate reception. Notwithstanding the foregoing, you acknowledge that you are the final recipient of this movable asset, and freely consent to your donation to the Municipality.
As a buyer and donor, you agree not to ask for any favor from SCNP, the Municipality, or the Supplier.
II. Payment methods
The system accepts the following means of payment: debit cards Visa, MasterCard, Magna, Diners Club, American Express, and Redcompra, and/or any other new payment methods that may eventually be accepted in the future, which will be timely informed on SCNP webpage.
The purchase with card is subject to approval of the issuer of your card. The use, conditions of payment and other conditions applicable to cards are the sole responsibility of the issuer.
The Supplier undertakes to manage the information collected during the payment process in accordance with the applicable law, as detailed in the VIth title of the present general terms and conditions.
III. Price
The unit price of each tree includes all of its costs linked to the purchase, transport and delivery to the Municipality.
IV. Right of withdrawal and returns
The right of withdrawal established in article 3 bis letter b) of Law No. 19.496 on Protection of Consumer Rights (Chile) does not apply to this kind of purchases and made by this mean.
V. Responsibilities
Pursuant to the Chilean Law No. 19.496 on the Protection of Consumer Rights, especially its Article 12, the Supplier undertakes to deliver a tree that complies with the relevant characteristics informed in the purchase process. In application of the Chilean Law No. 19.496 on the Protection of Consumer Rights, especially its Article 32, and in order to identify and correct errors in your data, you may contact the Supplier at the address indicated below:

VI. Privacy Policy
You hereby accept that the Supplier collects and uses personal data provided by you, such as your first and last name, address, and bank details, solely for the purpose necessary to carry out the transaction and for tax purpose. To this end, you voluntarily grant your authorization to the Supplier and its affiliated partners to use your personal data for an unlimited period of time until you deem it appropriate to withdraw it. In application of the Chilean Law No. 19.628 on the Protection of Private Life, especially its Article 4, you have the right to withdraw the authorization at any time and to enforce all the rights you have by law.
Pursuant to the Chilean Law No. 19.628 on the Protection of Private Life, your personal data will not be provided to third parties, except for specific notices and with their express consent. You have the right to withdraw his/her express consent at all times.
VII. Acceptance of donation
The Municipality undertakes to internally process the acceptance and reception in donation of each and every one of the trees that are donated under the carbon footprint program; and is obliged to destine them to its plantation in some land destined to this effect, and is located within the commune of Pudahuel. Likewise, the Municipality declares that the donations are exempt from the process of insinuation established in Article 1401 of Civil Code (Chile), as well as any tax for donations, in accordance with the provisions of Articles 22 and 10 of Decree with Force of Law No. 789 of 1978, on Acquisition and Disposition of Municipal Assets (Chile), and Article 18 of Law No. 16,271, Tax on Inheritance, Assignments and Donations (Chile).
VIII. Effects and change in the declaration
SCNP and the Supplier reserve the right to change or modify these general terms and conditions when it deems it appropriate. The new version will entry into force when published on webpage of SCNP.
IX. Jurisdiction and legal address
This purchase and donation is governed by and construed in accordance with the laws of the Republic of Chile.
Any difficulty or controversy that may arise between you, SCNP, the Municipality and/or the Supplier regarding the interpretation, validity or execution of this purchase and donation will be submitted to the competent courts in the commune and city of Santiago de Chile.
The parties establish a special conventional legal address in the city and commune of Santiago de Chile.
